The Reality

“When my son was hospitalized, I was shocked that doctors couldn’t update me because he was 18. We were on the same insurance, but legally, I was a stranger.”

Legal Reality: Insurance Coverage ≠ Access

At 18, a young adult becomes their own legal decision-maker. Without written authorization, schools and medical providers are legally barred from sharing information with parents—even in urgent situations.

This is not about taking control.

It’s about documenting the student’s choices so trusted people can help during a crisis without legal hurdles.

The 5 Missouri Essentials

Everything your student needs for full legal protection.

Durable POA

Student appoints trusted help for legal/financial matters if they are unable to act.

Healthcare POA

Names who can make medical decisions ONLY if the student cannot communicate.

HIPAA Release

Allows providers to discuss condition and treatment with authorized family members.

Living Will

Records preferences for serious medical scenarios, removing guesswork in a crisis.

FERPA Release

Enables sharing educational records (grades, disciplinary) with designated family.

FAQ

Is this about parents taking over?
No. The student remains in total control. They decide who is authorized and under what circumstances (like a medical emergency) that authority becomes active.
What if they are still on my insurance?
Insurance coverage does NOT authorize medical disclosure. Under HIPAA, once a child is 18, medical information is private regardless of who pays the premium.
Do we need an office visit?
No. The process is digital. Once you receive your documents, you follow our instructions for signing and witnessing (usually requiring a local notary).
